• No guarantee that listings are accurate, legal, or genuine
• No guarantee that items will sell or meet reserve prices
• No guarantee that buyers and sellers will complete transactions fairly
• No warranty of fitness for any particular purpose
• No warranty that the platform will be error-free or uninterrupted

2. No Participation in Transactions

WhaBid explicitly does NOT:

• Handle payments or hold funds in escrow
• Verify the authenticity, quality, or legality of items listed
• Verify buyer or seller identity beyond mobile number verification
• Participate in contract formation between buyers and sellers
• Provide insurance or protection for transactions
• Guarantee safe delivery or collection of items

3. User Responsibility

You acknowledge and agree that:

• You are solely responsible for all transactions
• You will conduct due diligence before bidding or buying
• You will verify seller or buyer identity independently
• You assume all risk of loss, fraud, or damage
• You will resolve disputes directly with the other party
• WhaBid will not mediate or settle disputes

4. No Liability

To the maximum extent permitted by South African law, WhaBid and its owners, operators, and staff are NOT liable for:

• Any direct, indirect, or consequential damages arising from platform use
• Loss of funds, items, or profits
• Fraud, theft, or scams perpetrated by other users
• Damage or loss during collection or delivery
• Platform downtime, errors, or technical failures
• Disputes, contracts, or agreements between users
• Misrepresentation or fraud by other users
• Any action or inaction by users on the platform

This applies even if WhaBid has been advised of the possibility of such damages.

5. Verification is NOT Guarantee

A "Verified Seller" or "Verified Buyer" badge means ONLY that:

• Mobile number verification has been completed
• A basic identity check has passed
• It does NOT guarantee honesty, reliability, or legal legitimacy
• It does NOT protect you from fraud or misrepresentation
• Verified users can still post fraudulent listings or fail to pay

6. Third-Party Content

WhaBid does not endorse or take responsibility for:

• Listings posted by users
• Comments or messages between users
• External links or websites referenced on the platform
• Third-party services integrated with WhaBid

7. Limitation of Liability

Even if any part of this disclaimer is found unenforceable, WhaBid's total liability for all claims shall be limited to the amount paid by the user (if any) in the past 12 months.

8. Indemnification

You agree to indemnify and hold WhaBid harmless from any claims, damages, or costs arising from:

• Your use of the platform
• Transactions you conduct
• Violation of these terms or applicable law
• Infringement of third-party rights

9. Safe Trading Recommendations

While WhaBid cannot guarantee safety, we recommend:

• Always meet sellers/buyers in safe, public locations
• Bring someone with you to high-value transactions
• Inspect items thoroughly before payment or handover
• Pay only after verifying item authenticity
• Avoid sharing personal details off-platform until after auction ends
• Report suspicious activity to WhaBid immediately
